1. Background

• You (the Client) wish to engage the Contractor (Gracie Davies) to provide design services.
• The Contractor agrees to provide these services based on the terms below.

2. Services and Deliverables

Full Design Service (£395)

• What’s included: A kitchen, utility room, or bathroom design based on your measurements and style preferences.
• Revisions:
• Kitchen: Up to 5 iterations.
• Utility Room: Up to 3 iterations.
• Bathroom: Up to 2 iterations.
• Extra Drafts: Any additional drafts requested beyond these limits will be charged at £45 for a block of up to 2 drafts. Work on extras will begin once payment has been received.
• Final Deliverables: Finalised floorplan, fitting notes, and order placement (for DIY Kitchens clients).

Sense Checking Service (£60)

• What’s included: Up to 2 hours of analysis and improvements on a design you’ve already created.
• Format: Changes made on a cloned copy of your floor plan with written/verbal explanations.
• Exclusions: This does not include checking room setup or measurements. Revisions are only included if within the 2-hour time limit.

Price Comparison Service (£60)

• What’s included: Creating a DIY Kitchens design that resembles a provided design.
• Deliverables: Images and estimated pricing for up to 2 door ranges.
• Ownership: This plan is created on Gracie Davies’ account and ownership of the plan remains with the Contractor.
• Exclusions: No revisions or room measurement setup included.

3. Fees and Payment

3.1 The fee for the Price Comparison service is £60.
3.2 The fee for the Sense Checking service is £60.
3.3 The fee for the Full Design service is £395.
3.4 The fee for the Bathroom Design service is £395. For existing kitchen design clients, the fee for the Bathroom Design service is half price (£197.50).
3.5 Utility rooms are charged based on floor area as follows: Small Utility (£60): Up to 4m²; Medium Utility (£120): 4m² to 8m²; Large Utility (£200): Over 8m².
3.6 If you choose to upgrade from the Price Comparison or Sense Checking service to Full Design, the remaining balance of £335 will be due.
3.7 I operate on a first-come, first-served basis. At the time of enquiry I will give you a week commencing (W/C) date, slots are then filled in the order that payment is received. Please note that slots are only secured by payment.
3.8 All quotes provided are valid for 30 days from the date of issue. Prices for services are subject to change for future bookings, and Gracie Davies reserves the right to update website pricing at any time without prior notice. Any third-party discounts, promotions, or cashback offers (including the DIY Kitchens cashback offer) are provided by the relevant third party and may be changed, withdrawn, suspended, or made unavailable at any time without notice; Gracie Davies is not responsible for any such changes or for any resulting loss of discount/cashback.
3.9 If your project includes particularly complex elements, or requires additional work blocks, these are charged at £45. I will confirm and agree any additional fees with you before invoicing.

4. DIY Kitchens Cashback Service

• The Offer: When using my design service and ordering via my specific designer link/process, you may be eligible for cashback on the cost of DIY Kitchens units and doors.
• Rates (Full Price):

• Rates (During Sales):
• Standard ranges: 5%
• Exclusions: (Updated 2/3/2026 effective immediately) True handleless styles, in-frame ranges, and bespoke colour units are excluded and receive no cashback. Cashback is calculated on standard units and doors only (excluding VAT, delivery, worktops, appliances, and accessories).
• Client Responsibility: To qualify, you MUST follow the ordering instructions provided by the Contractor exactly. If you place an order without using the specified method, the cashback cannot be applied retrospectively, and the Contractor is not liable for the loss of this discount.
• Payment & Timing: Cashback is processed after your order is confirmed and is either deducted from your outstanding balance or paid as a refund. The Contractor is a facilitator of this offer; the cashback is ultimately subject to DIY Kitchens’ own terms and verification. The Contractor is not liable if DIY Kitchens rejects a cashback claim due to client error or changes in their third-party policy.
• Change/Withdrawal of Offer: The cashback/discount offer is provided by DIY Kitchens and/or via their third-party partner and may be amended, withdrawn, suspended, or made unavailable at any time without notice. No cashback is guaranteed unless and until it is approved and paid out by DIY Kitchens (or their partner) in accordance with their then-current terms.

5. Feedback and Revisions

• Communication: Feedback on design drafts may be provided orally via phone or in writing via WhatsApp or Email. For record-keeping and clarity, Email is the preferred method of communication for all design feedback.
• Client Edits to Designs: Clients are permitted to make copies of the Contractor’s designs for their own personal review. However, if a client chooses to manually edit a design file themselves, the Contractor is not obliged to continue working on that edited version.
• Efficiency: To ensure the project stays on track, the Contractor will only continue work based on the original versions created by the Contractor. Editing a version modified by the client often requires significant additional time to correct and align; if the Contractor agrees to work on a client-edited file, this may incur an additional "Scope Creep" fee.

6. Measurements & Liability

• Measurements: Designs are created based on measurements provided by you. The Contractor is not responsible for fitting issues caused by incorrect measurements or unforeseen site obstacles.
• Architectural Drawings: If measurements come from drawings, you must confirm they are 100% accurate before ordering.
• The Fitter’s Check (Crucial): You MUST have a professional fitter physically check the floor plan and verify all measurements on-site before placing an order. Placing an order signifies that your fitter has confirmed the design is suitable for the space.

7. Project Duration and Expiration

7.1 My design packages are valid for 12 months from the date of purchase. After 12 months, client data is deleted as per Section 7.3. If I do not hear from you ahead of the 12-month expiration, your project will expire and any fees paid will be non-refundable.
7.2 However, if your project is still active and we remain in regular contact, I will happily extend the service period to ensure your design is completed.
7.3 Client data and project files are permanently deleted 12 months after engagement or once the project is completed if extended beyond 12 months.

8. Liability and Accuracy

8.1 Liability and Accuracy: I design based on the measurements and/or structural drawings provided by you. While I take every care to incorporate visible details (such as nibs, columns, or RSJs), Gracie Davies is not liable for:

• Inaccuracies in the measurements or drawings provided;
• Structural elements or utilities not clearly disclosed or correctly dimensioned;
• Changes made to the site after the design is finalised.
  It is your responsibility (or your fitter's) to verify all dimensions on-site and crosscheck against my provided plans before ordering any units.

9. Imagery and Accuracy

• AI-generated imagery is provided for illustrative purposes only and should not be relied upon for exact accuracy. For ordering and installation accuracy, you must always refer to the provided floorplans and elevations.

10. Third-Party Products & Ordering

• Role: Gracie Davies acts as a design consultant. Any contract for the purchase of goods (units, doors, etc.) is strictly between you and the supplier (e.g., DIY Kitchens).
• No Liability for Goods: The Contractor is not responsible for errors made by the supplier, including but not limited to: delivery delays, damaged items, missing parts, or manufacturing defects.

11. Payment & Cancellation

• Fees: Charged at the rates stated on www.graciedavies.com/fees.
• Timing: Payment is required in full before design work commences.
• Cooling-off Period: Under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period from the date of payment.
• Waiver for Early Start: If you request work to start within the 14-day cooling-off period, you agree that your right to cancel is limited once work begins. The following cancellation fees apply:
• Cancellation more than 48 hours before your agreed design start date: Full refund, minus any banking or transaction fees.
• Cancellation within 48 hours of your agreed design start date: 50% refund (to cover the reserved time and loss of other potential bookings).
• Once the design work has commenced: No refund is available.

12. Limitation of Liability

• To the maximum extent permitted by law, Gracie Davies’ total liability for any claim arising out of this agreement shall be limited to the total amount of the fee paid by the Client for the service.

13. Intellectual Property & Marketing

• Ownership: All designs and materials remain the property of the Contractor.
• Licence: You are granted a non-exclusive licence to use the designs for your specific project.
• Marketing Rights: The Contractor reserves the right to use the designs, 3D renders, and (with your permission) photos of the finished project for marketing purposes, portfolios, and social media.

14. Data & Confidentiality

• No personal data will be shared with third parties, except where necessary to place orders on your behalf.
• Client data is deleted 12 months after the agreement ends unless otherwise agreed.

15. Governing Law

• This agreement is governed by the laws of England and Wales.
