Terms & Conditions
These terms and conditions were displayed for bookings until 20th July 2026
By engaging in my services you are agreeing to the below terms and conditions.
1. Background
The Client wishes to engage the Contractor, Gracie Davies trading as Gracie Davies independent designer, to provide design services for a kitchen, utility room, bathroom or other room as agreed. The Contractor agrees to provide those services in accordance with these Terms and Conditions.
2. Services and Deliverables
Full Design Service
Fee: £395 for kitchens, £295 for bathrooms and other rooms priced according to size.
Scope: A bespoke design for a kitchen, utility room, bathroom or other room based on measurements and style preferences provided by the Client.
Revisions:
Kitchen: up to 5 iterations.
Utility room: up to 3 iterations.
Bathroom: up to 2 iterations.
Extra drafts: Additional drafts beyond these limits are charged at £60 each. Work on additional drafts will commence only after payment has been received.
Final deliverables: A finalised floor plan for all rooms, fitting notes which are not provided for bathrooms, and guidance on order placement specifically for DIY Kitchens clients.
Sense Checking Service
Fee: £60.
Scope: Up to 2 hours of professional analysis and improvements to a design already created by the Client.
Format: Modifications made to a cloned copy of the Client's floor plan, accompanied by written or verbal explanations.
Exclusions: This service does not include verification of the room setup or measurements. Revisions are included only where completed within the 2 hour time limit.
Price Comparison Service
Fee: £60.
Scope: Creation of a DIY Kitchens design that resembles a provided external design.
Deliverables: Visual imagery and estimated pricing for up to 2 door ranges.
Ownership: The plan is created on the Contractor's account and ownership remains with the Contractor.
Exclusions: No revisions or room measurement setup are included.
3. Fees and Payment
3.1 The fee for the Price Comparison Service is £60.
3.2 The fee for the Sense Checking Service is £60.
3.3 The fee for the Kitchen Design Service is £395.
3.4 The fee for the Bathroom Design Service is £295. Existing kitchen design clients receive this service at a discounted rate of £197.50.
3.5 Utility rooms are charged by floor area: small, £60, up to 4m²; medium, £120, from 4m² up to 8m²; large, £200, over 8m².
3.6 Bedrooms and media walls are charged by size: small to medium, £120, for a single wall made up of multiple units; large, £200, for a full room, walk in wardrobe, multiple features or complex angles.
3.7 Upgrades from the Price Comparison Service or Sense Checking Service to the Full Design Service require payment of the remaining balance. The remaining balance is £335 where the applicable Full Design Service fee is £395. Where the applicable Full Design Service fee is £295, the remaining balance is £235.
3.8 Missing information: Design appointments that the Contractor is unable to commence because the Client has failed to provide all required information, including but not limited to measurements and specifications, are subject to clause 7.4. The Contractor will commence the design as soon as schedule availability permits once all necessary details have been provided.
3.9 All quotes are valid for 30 days. Prices are subject to change for future bookings. Gracie Davies reserves the right to update website pricing without prior notice. Third party promotions or cashback offers are the responsibility of the third party and may be withdrawn at any time.
3.10 Complex elements or additional work blocks are charged at £60, subject to prior agreement and invoicing.
4. DIY Kitchens Cashback Service
The offer: Clients using the design service and ordering through the Contractor's specific link or process may be eligible for cashback, being 10 percent as standard or 5 percent during sales.
Exclusions: True handleless styles, in frame ranges and bespoke colour units are excluded. Cashback is calculated on standard units and doors only, excluding VAT, delivery, worktops, appliances and accessories.
Client responsibility: Instructions must be followed exactly. Failure to use the specified ordering method means that cashback will not be available. The Contractor is not liable for this loss.
Withdrawal: The offer is provided by third parties and may be amended or withdrawn without notice. No cashback is guaranteed until it has been approved and paid by the supplier.
5. Feedback and Revisions
5.1 Communication: Feedback should be provided by email.
5.2 Turnaround time: The Contractor aims for a turnaround time of three working days for revised drafts following receipt of feedback. For example, feedback received on a Friday will have a target revised draft delivery date of the following Wednesday.
5.3 Client edits: Clients may copy designs for personal review. However, the Contractor is not obliged to work on files manually edited by the Client. If the Contractor agrees to correct a client edited file, an additional Scope Creep fee of £60 for up to 2 hours may be applied.
6. Measurements and Liability
6.1 Accuracy: Designs are based solely on measurements provided by the Client. The Contractor is not responsible for fitting issues resulting from incorrect measurements or undisclosed site obstacles.
6.2 Architectural drawings: The Client must verify the accuracy of measurements derived from drawings before ordering.
6.3 The fitter's check: It is a mandatory requirement that a professional fitter physically verifies the floor plan and on site measurements before an order is placed. Placing an order signifies that the fitter has confirmed the design's suitability for the space.
7. Project Duration and Expiration
7.1 Design packages are valid for 12 months from the date of purchase.
7.2 If a project remains active and in regular communication, the Contractor may extend the service period.
7.3 Client data and project files are permanently deleted 12 months after engagement or upon project completion, subject to any legal or regulatory retention requirement.
7.4 If the Contractor is unable to commence the design on the agreed start date because the Client has not provided all required information, including but not limited to accurate measurements, style preferences, appliance details and any other information requested, fees paid will be non refundable, except where a refund is required by law.
The Contractor will commence the design as soon as reasonably practicable once all required details have been provided. However, the Client will lose their place in the design queue and the project will be subject to the Contractor's availability between other booked clients.
8. Liability and Accuracy
8.1 Gracie Davies is not liable for inaccuracies in drawings or for structural elements that are not correctly dimensioned or disclosed, or for site changes made after the design has been finalised.
8.2 The Client or their fitter must cross check all dimensions on site against the plans before ordering.
9. Imagery and Accuracy
9.1 AI generated imagery is for illustrative purposes only. For installation and ordering, the Client must refer to the floor plans and elevations.
10. Third Party Products and Ordering
10.1 Gracie Davies acts as a design consultant. The contract for goods is strictly between the Client and the supplier, such as DIY Kitchens.
10.2 The Contractor is not liable for supplier errors, including delivery delays, damage or manufacturing defects.
11. Payment and Cancellation
11.1 Cooling off period: Where the contract is a distance or off premises contract to which the Consumer Contracts Regulations 2013 apply, the Client has a statutory 14 day cancellation period beginning on the day after the contract is entered into.
The Client may cancel during this period without giving a reason, subject to the provisions of clauses 11.2 and 11.3 and any other statutory rights.
11.2 Services requested during the cooling off period: If the Client expressly requests in a durable medium that work begins during the 14 day cancellation period, the Contractor may begin work before that period ends.
If the Client then cancels, the Client may be required to pay a proportionate amount for the service supplied before cancellation, in accordance with the Consumer Contracts Regulations 2013.
If the service is fully performed following the Client's express request, the statutory cancellation right may end where the legal requirements are satisfied.
11.3 Cancellation after the cooling off period: Subject to any statutory rights, the following cancellation provisions apply:
(a) Cancellation less than 48 hours before the start date: 50 percent of the applicable service fee will be retained or will become payable.
If less than 50 percent has been paid, the outstanding balance of the cancellation charge must be paid within 7 days.
If more than 50 percent has been paid, the balance above 50 percent will be refunded, less any non refundable transaction fees.
(b) Cancellation on the day of the appointment or after work has commenced: no refund is available, subject to any statutory rights.
11.4 Where clause 7.4 applies because the Client has not provided the required information, clause 7.4 takes precedence over clause 11.3, subject to any statutory rights.
12. Limitation of Liability
To the maximum extent permitted by law, the Contractor's total liability is limited to the total fee paid by the Client for the specific service.
13. Intellectual Property and Marketing
13.1 All designs remain the property of the Contractor. The Client is granted a non exclusive licence to use the design for the specific project.
13.2 The Contractor reserves the right to use designs and renders for marketing and social media. Project photographs will only be used with the Client's permission.
14. Data and Confidentiality
14.1 Personal data is not shared with third parties except where necessary for ordering or providing the agreed services.
14.2 Data is deleted 12 months after the agreement ends, subject to any legal or regulatory retention requirement.
15. Governing Law
This agreement is governed by the laws of England and Wales.
